Personal data protection charter

Article I. PREAMBLE

The present charter relating to the protection of personal data (hereinafter referred to as the " Charter ) defines the terms and conditions for the collection, use and sharing of personal data (hereinafter referred to as the "Data"). Data "for the specific purposes of this Charter) that STARPEACE may collect in the course of performing the Services it provides to its Users (hereinafter referred to indifferently as the User, or the Buyer, in the case of a Product Order).

Article II. DEFINITIONS

Each of the contractual terms defined in the CGUV are deemed to have the same meaning in the context hereof, except in the event of contradiction with the definitions listed below, which shall prevail.

Buyer(s ): refers to any natural person having the capacity to enter into a contract, i.e. having reached the legal age of majority in his/her country and not being protected within the meaning of article 488 of the French Civil Code and/or article concerning the capacity of persons in force in his/her country, and wishing to purchase one or more Products privately as part of his/her personal activity;

 

Order: refers to the process by which the User orders a Product on the Site, which will be delivered to him/her at the end of the Sales process;

 

Cookies: refers to a small information file sent to the User's browser and stored on the User's terminal (e.g. computer, smartphone). This file includes information such as the User's domain name, the User's Internet service provider, the User's operating system, and the date and time of access. Cookies are in no way likely to damage the User's terminal. 

Charter: means the terms and conditions of collection, use and sharing of Data that STARPEACE may collect as part of the performance of the Services it provides;

Data: means any information directly or indirectly identifying a natural person within the meaning of Regulation No. 2016/679, the so-called General Regulation on the Protection of Personal Data, which came into force on May 25, 2018 (hereinafter referred to as the " RGPD ") ;

Products: shall designate all Products offered for Sale on the Site;

 

Site: refers to the online web site available at go-starpeace.com or any other address that may be substituted;

Processing of personal data: means any operation, or set of operations, relating to such data, regardless of the process used (collection, recording, organization, storage, adaptation, modification, extraction, consultation, use, communication by transmission dissemination or any other form of making available, reconciliation or interconnection, blocking, erasure or destruction, ...) within the meaning of the RGPD ;

User: refers to any consumer who uses the Site;

 

Service(s): means all services and certain individual services offered to each User by STARPEACE via the Website, and more particularly the possibility offered to the User to access the Website, to choose online the Product(s) he wishes to order, as well as the possibility to make the payment of the online Sale.

 

Article III. FIELD OF APPLICATION

 

 

 

PERSONAL DATA PROTECTION CHARTER

STARPEACE reserves the right to modify this Privacy Policy from time to time, in accordance with developments in the Services offered or changes in legislation, at its sole discretion. STARPEACE's data management policy is always subject to the most recent version of the Charter. The User is invited to consult this Charter as often as necessary.

Article IV. COLLECTION OF USER DATA

4.01 Information collected

This information includes, in particular, User Data collected when accessing the Services, such as :

 

If the User is a private individual :

  • Name;
  • First name;
  • The User's telephone number ;
  • The User's full address;
  • The User's e-mail address ;
  • The User's billing address, if applicable.

 

This data is mandatory in order to access the Services. Failure to provide this Data may result in the User being unable to access the Services.

 

4.02 Shelf life

The Data collected and processed will be kept for the entire duration of the Services, so as not to exceed the period necessary for the purposes for which they are processed.

 

They will be kept for a period of 2 (two) years for the transmission of any commercial offer to the User, by any means whatsoever.

 

In any event, certain categories of Data will be subject to intermediate archiving at the end of the performance of the Services, or their interruption for any reason whatsoever, if such Data are required by STARPEACE to provide evidence in the event of litigation. The duration of this intermediate archiving will be 5 (five) years from the date of interruption, with the exception of the proof of the subscription to the Services as well as the copy of the Contract, which will be kept, if applicable, for a duration of 10 (ten) years from the execution of the Services, pursuant to article L 213-1 of the French Consumer Code.

 

In the event that the Contract signed between STARPEACE and the User has been suspended or blocked, the Data will be kept for a period of 5 years from the date of suspension with the exception of proof of subscription to the Services and the copy of the Contract, which will be kept, where applicable, for a period of 10 (ten) years from the date of execution of the Services, pursuant to Article L 213-1 of the French Consumer Code.

 

4.03 Various treatments carried out

STARPEACE uses the Data collected from Users for the purposes of :

 

  • The performance of the Services agreed between it and the User;
  • The transmission to the User, where applicable, of information on the Services by e-mail, SMS or any other means of communication, within the limits of the authorization given by the User;
  • Improving service quality;
  • Ensure compliance with (i) applicable legislation, (ii) normal use of the Services and (iii) this Charter;
  • To transmit to the User, in accordance with applicable legal provisions and with the User's consent where required by law, marketing, advertising and promotional messages, invitations to events and information relating to the use of the Services;
  • List the User in internal databases;
  • To enable browsing on the Site and the management and traceability of Services ordered by the User: connection and Site use data, invoicing, order history, etc.
  • To prevent and combat computer fraud (spamming, hacking...), the computer equipment used for browsing, the IP address, the password (hashed) ;
  • To improve navigation on the Site: connection and usage data;
  • To conduct optional satisfaction surveys on the Site.

4.04 Recipients and reasons for transmission of collected Data

STARPEACE collects and personally processes User Data through its legal representative and his team, its employees or external service providers, who are in any case bound by a confidentiality clause and informed of the security obligations related to the collection and processing of Data.

 

In the course of using the Services, some of the information collected may be transmitted to :

  • STARPEACE teams (its legal representative and, where applicable, its collaborators, employees, occasional trainees or external service providers);
  • To the RGPD-certified applications STARPEACE needs to process the actions it performs, where applicable;
  • STARPEACE IT department;
  • STARPEACE's data hosting and backup server;
  • Where STARPEACE is legally obliged to do so, in order to comply with any legal request;
  • In the event that STARPEACE transfers its business by any means whatsoever to the potential transferee of its goodwill or shares in its share capital.

4.05 Data transfer

The Data is stored in France, on STARPEACE's premises. The service providers selected by STARPEACE have undertaken to STARPEACE not to transfer any Data outside the European Union. To date, no transfers outside the European Union have been reported. Should this be the case in the future, the service providers selected by se STARPEACE are committed to STARPEACE (i), to inform it in advance and (ii) to comply, in any event, with the provisions of the RGPD so that the minimum protection guarantees of this regulation are met.

4.06 Hypertext links, cookies and Internet tags

The Site contains a number of hypertext links to other sites, set up with the authorization of STARPEACE. However, STARPEACE is not in a position to check the content of sites visited in this way, and consequently assumes no liability in this respect. 

Unless the User decides to deactivate Cookies, he/she accepts that the Site may use them. The User may deactivate these Cookies at any time, free of charge, using the deactivation options described below, in the knowledge that this may reduce or prevent access to all or part of the Services offered by the Site.    

4.07 "COOKIES

STARPEACE may process information about the User's visit to the Website, such as pages viewed and searches performed. This information enables STARPEACE to improve the content of the Site and the User's browsing experience. 

As Cookies facilitate browsing and/or the provision of the Services offered by the Site, the User may configure his/her browser to allow him/her to decide whether or not to accept them, so that Cookies are stored in the terminal or, on the contrary, are rejected, either systematically, or depending on the sender. The User may also configure his browser software so that acceptance or rejection of Cookies is offered to him from time to time, before a Cookie is likely to be stored in his terminal. STARPEACE informs the User that, in this case, not all functions of his browser may be available. 

If the User refuses the storage of Cookies in his terminal or browser, or if the User deletes those stored there, the User is informed that his browsing and experience on the Site may be limited. This may also be the case when STARPEACE or one of its service providers cannot recognize, for technical compatibility purposes, the type of browser used by the terminal, the language and display settings or the country from which the terminal appears to be connected to the Internet. 

Where applicable, STARPEACE declines all responsibility for the consequences linked to the degraded functioning of the Website and of the Services possibly offered by STARPEACE resulting (i) from the refusal of Cookies by the User (ii) from the impossibility for STARPEACE to record or consult the Cookies necessary for their functioning due to the User's choice. For the management of Cookies and the User's choices, the configuration of each browser is different. It is described in the browser's help menu, which will indicate how the User can modify his or her wishes with regard to Cookies. 

At any time, the User may choose to express and modify his/her wishes with regard to Cookies. STARPEACE may also use the services of external service providers to help it collect and process the information described in this section. 

Lastly, by clicking on the icons dedicated to the social networks featured on the Site, and if the User has accepted the deposit of cookies by continuing to browse the Site, Twitter, Facebook, LinkedIn and Pinterest, Instagram may also deposit cookies on their terminals (computer, tablet, cell phone).

These types of cookies are deposited on the User's terminal only if the User consents to them by continuing to browse the Site. At any time, the User may withdraw his consent to STARPEACE depositing this type of cookie.

4.08 INTERNET TAGS

STARPEACE may occasionally use Internet tags (also known as tags ", or action tags, single-pixel GIFs, clear GIFs, invisible GIFs and one-to-one GIFs) and deploy them through a specialist web analytics partner that may be located (and therefore store the related information, including the User's IP address) in a foreign country. This provider has undertaken with STARPEACE to comply with the RGPD and is responsible, in its capacity as processor, for the use of the Data it may make.

These beacons are placed both in online advertisements enabling Internet users to access the Site, and on its various pages.

This technology enables STARPEACE to evaluate visitors' responses to the Site and the effectiveness of its actions (for example, the number of times a page is opened and the information consulted), as well as the use of the Site by the User.  

The external service provider may collect information about visitors to the Website and other websites using these tags, compile reports on Website activity for STARPEACE, and provide other services relating to the use of the Website and the Internet. 

4.09 The User's right to his Data

The User has the right to obtain a copy of the Data held about him by STARPEACE. To do so, the User shall (i) either send its request by e-mail to the following address contact@go-starpeace.com if applicable, (ii) or send its request by letter to STARPEACE at 23 allée des merisiers, 77166 EVRY-GREGNY-SUR-YERRES.

 

STARPEACE shall endeavour to comply with the User's request within a reasonable time and, in any event, within the time limits set by law.

 

The User also has the possibility to access the Data held by STARPEACE in order to ask STARPEACE to rectify, modify or delete any incorrect information.

 

The User has the right to oppose or limit the processing of his/her Data.

 

The User has the right to lodge a complaint with the competent supervisory authority (the CNIL) or to obtain redress from the competent courts if it considers that STARPEACE has not respected its rights. 

 

The User also has the right to Data portability, i.e. the right to receive the Data provided to STARPEACE in a structured, commonly used and machine-readable format and the right to transmit such Data to another data controller.

 

Finally, the User, his legal representative, employees or collaborators, who are in contact with STARPEACE has, if applicable, also the right to define directives concerning the fate of his Data after his death.
